Employment & Labor Law

Our employment law practice encompasses the full range of individual and collective labor relations matters arising under Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act (ADEA), the Americans with Disabilities Act (ADA), the Family and Medical Leave Act (FMLA), and the Fair Labor Standards Act (FLSA). We represent both employees and employers in wrongful termination claims, discrimination and harassment litigation, wage and hour class and collective actions under 29 U.S.C. ยง 216(b), non-compete and trade secret misappropriation disputes, and NLRB proceedings involving alleged unfair labor practices under 29 U.S.C. ยง 158.

In the context of corporate restructuring and reduction-in-force events, we advise clients on WARN Act compliance obligations under 29 U.S.C. ยง 2101 et seq., severance agreement enforceability including the requisite knowing and voluntary waiver requirements under the Older Workers Benefit Protection Act (OWBPA), and the negotiation of separation agreements that effectuate a valid and enforceable release of claims pursuant to applicable statutory and common law standards.

Real Estate & Property Law

Our real property practice addresses transactional, regulatory, and litigation matters arising in connection with commercial and residential real estate assets, including the drafting and negotiation of purchase and sale agreements, easement agreements, covenants, conditions and restrictions (CC&Rs), leasehold estates, ground leases, and sale-leaseback arrangements. We conduct comprehensive due diligence reviews encompassing title examination, survey analysis, environmental assessment integration, zoning and land use compliance, and the negotiation of representations, warranties, and indemnification provisions customarily included in real estate acquisition agreements.

In contested matters, we handle landlord-tenant disputes involving breach of the implied warranty of habitability, constructive eviction claims, retaliatory eviction defenses under applicable state statutes, security deposit litigation, and disputes arising under commercial triple-net lease agreements including the proper allocation of operating expenses, capital expenditure obligations, and tenant improvement allowances.

Family Law & Domestic Relations

Our domestic relations practice encompasses dissolution of marriage proceedings, post-decree modification of child custody, visitation, and support orders, enforcement of domestic support obligations including income withholding orders and contempt proceedings, division of marital property including the characterization of separate versus community property interests, valuation and equitable distribution of closely held business interests, defined benefit pension plans, stock options, and deferred compensation arrangements, as well as the negotiation and drafting of prenuptial and postnuptial agreements that satisfy the requisite procedural and substantive fairness standards for enforceability under applicable state law.

Fee Structure

Our fee arrangements are structured to align attorney compensation with client outcomes. We offer hourly billing at rates commensurate with attorney experience and matter complexity, contingency fee arrangements in appropriate personal injury and employment discrimination matters pursuant to applicable Rules of Professional Conduct, and hybrid retainer structures combining a reduced hourly rate with a success-based performance component. All fee arrangements are memorialized in a written engagement letter as required by applicable state bar regulations.
